1. Introduction
These Terms and Conditions govern access to and use of BrightMind, an education technology platform designed to support schools with school management, academic administration, communication and e-learning services.
2. About BrightMind
BrightMind provides software and digital services to schools. BrightMind is a technology service provider and does not itself operate a school or replace the legal, professional or administrative responsibilities of a school.
3. Accounts and Access
Schools and authorized users are responsible for maintaining the confidentiality of their login credentials and for activities carried out through their accounts. Users must provide accurate information and must not share accounts in a manner that compromises security.
4. Acceptable Use
Users must use BrightMind lawfully and responsibly. You must not attempt to gain unauthorized access, interfere with the platform, introduce malicious code, abuse communication services, or use the system for unlawful, fraudulent or harmful activities.
5. School and Learner Information
Schools remain responsible for information they enter, upload or manage through BrightMind and for ensuring that they have the appropriate authority and permissions to process such information. Schools should use appropriate internal controls when creating accounts and assigning access.
6. Subscriptions and Payments
Where BrightMind services are provided under a paid subscription, the applicable package, price, duration and payment conditions displayed by BrightMind will apply. Subscription access is subject to successful payment and verification where applicable.
7. SMS Services
Where SMS services are available, schools are responsible for recipients and content of messages sent through the platform. SMS credits, package prices and related conditions are determined by the applicable BrightMind package.
8. Intellectual Property
BrightMind software, interface designs, branding, documentation and related materials are protected by applicable intellectual property laws. Except where expressly permitted, users may not copy, reproduce, modify, distribute or commercially exploit BrightMind proprietary materials.
9. Service Availability
BrightMind aims to provide reliable services but cannot guarantee uninterrupted availability at all times. Temporary interruptions may occur because of maintenance, infrastructure problems, internet connectivity, third-party services or circumstances beyond BrightMind's reasonable control.
10. Suspension and Termination
BrightMind may suspend or restrict access where necessary for security, non-payment, misuse, violation of these terms or protection of the platform and its users. Schools may discontinue use subject to applicable subscription or payment obligations.
11. Limitation of Responsibility
Schools are responsible for administrative decisions, learner records, user permissions and the accuracy of information entered into the system. BrightMind provides technology intended to support school operations and does not assume the school's statutory or professional responsibilities.
12. Changes to These Terms
BrightMind may update these Terms and Conditions when necessary to reflect changes in its services, technology, legal requirements or business operations. Updated terms may be published through the platform or website.
